ONLINE STORE TERMS
CAPACITY.
Minors may enter the “SITE” and open a profile, but the payment purchase process must be carried out by someone who is of legal age to purchase goods or contract services.

The CUSTOMER or user may not alter the SITE and/or add any information without having the corresponding copyright or industrial property rights.
PRICES AND PRICES
The price of the “PRODUCTS” will be the one stipulated by AZUL at any given time on the “SITE”. The prices of the products are already expressed in Mexican pesos and include VAT, but do not include shipping costs, so the cost of the latter will be added to the total amount of the “PRODUCTS” purchased prior to the “CUSTOMER” making the payment.
AZUL reserves the right to modify the prices at any time, said price modifications will not affect the purchase process carried out by the CUSTOMER, as long as there is no Order Confirmation.
The “CUSTOMER”, to carry out the “Check Out” as a first step, will select the “PRODUCTS” that he/she wishes to purchase, which will be added to the cart. In the second step, you must add the address to validate that you have delivery coverage at the destination, as a third step, select the shipping method and finally, select the payment method and confirm the order.
The cost for shipping costs will be independent of the price of the “PRODUCT(S)” and will depend on the distance or shipping address, type of service and coverage.
AZUL will provide the “CUSTOMER” with various forms of payment, including cash deposits, credit or debit cards and any other that is enabled or available on the “SITE”.
The “CUSTOMER” may make changes in the “Check Out” of products assigned to the cart, delivery address, shipping method and payment method, only before confirming the payment, otherwise the order cannot be modified or cancelled. In case a modification or cancellation is required, it must be managed as a return once the package is delivered.
The “CLIENT”, by confirming the payment, is accepting that the credit or debit card with which the payment is being made is his/her own, or that of the parent or guardian of the minor, therefore, in this act, the “CLIENT” releases AZUL from any liability for misuse, impersonation, cloning, identity theft and/or any other assumption related to the improper use of this means of payment.
All credit and/or debit cards will be subject to verification and authorization by the payment processors (Mercado Pago, PayPal) or the bank that issued them; in the event that said entity does not authorize the payment, the “CLIENT” will be immediately notified.
AZUL will not be responsible for any delay or lack of delivery of the “PRODUCTS” or commission generated by the lack of authorization or rejection of charge by the issuing entity of the payment method selected by the “CLIENT”.
The “CLIENT” authorizes us to verify the authenticity and sufficiency of the payment information that you have provided us, and if we cannot verify this information automatically, we will contact you through our payment processors that you have selected to confirm your identity and/or your attempt to place an order.
In the event that you select the Offline payment option, the purchase will be considered to be made until this method is confirmed.
The CLIENT accepts that he or she is aware that AZUL may use technology to validate the identity of the CLIENT at the time of purchasing items and products.
The “CLIENT” declares that all economic resources and means of payment used for the payment of the items and products are of lawful origin.
MODIFICATIONS TO THE SERVICE AND PRICES
(a) The prices of our products are subject to change without prior notice.
(b) We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.
(c) We will not be liable to you or any third party for any modification, price change, suspension or discontinuance of the Service.
Warranty and Limits of Liability:

(b) We have made every effort to display as accurately as possible the colors and images of our products that appear in the store. We cannot guarantee that your computer monitor's display of any color will be accurate.
(c) We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any product or service that we offer. All product descriptions or product prices are subject to change at any time without notice. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.
(d) We do not guarantee that the quality of any product, service, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.
PROCEDURE FOR PURCHASING GOODS ON THE SITE
CREATION OF ORDERS
In order to make a purchase, the CUSTOMER must enter the SITE where the categories of the articles are shown in the various sections, among which are indicated as an example, clothing, accessories, footwear, among others.
THE CUSTOMER may select and add to the "Shopping Cart" the articles that he wishes to purchase, selecting their characteristics such as color, size, variations in design, which must be selected only from the options shown on the SITE.
It is indicated that the physical characteristics of the articles may vary, without responsibility of AZUL, derived from the vision that could be shown on the device used for the purchase.
Once the products have been selected, the CUSTOMER must continue with the purchase, shipment, and payment of the articles.
The User accepts that the availability of the articles will be confirmed until the moment prior to selecting the type of payment for them, so the selection in the Shopping Cart does not constitute the formalization of the purchase.
Once the payment for the articles has been made, a receipt of the transaction made will be generated, identifying the transaction number, details, and shipping address of the article (hereinafter "Order Confirmation").
By sending an order at AZUL, you agree to enter into the terms of service described in this agreement.
ACCURACY OF BILLING AND ACCOUNT INFORMATION
We reserve the right to reject any order you place with us. We may, at our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit changes to or cancellations made by third parties.
All orders will be shipped between Monday and Friday, within 5 business days, except in cases where there are national holidays. Please note that orders placed during national/public holidays may experience longer processing and delivery times.
Missing Items in Deliveries:
If upon arrival you notice that an item is missing from your order, please be sure to take photos of the packaging it arrived in along with a photo of the item(s) received and email us at azul.fitnnes@gmail.com. All orders are scanned and weighed to ensure order accuracy. The pick and pack area of our warehouse is also under camera surveillance, which we review in these cases. We do not offer refunds for missing items in the event that our testing indicates that all items were fulfilled.
Damaged Deliveries:
If your package arrives damaged, please immediately take a photo and send it to our customer experience team. You should be careful when opening the product so as not to damage it, especially when using any sharp instruments. AZUL is not responsible for any damage caused by this.
CHANGE OF MIND RETURNS: REFUNDS, STORE CREDIT & EXCHANGES
If you are not happy with your AZUL pieces, we offer the option to return the item to us. Your pieces can be returned within 10-20 days of your delivery date and must meet our return requirements below.
In order for your item(s) to be accepted upon return, it must meet the following criteria:
It must be unworn, unwashed and in the original packaging with tags attached.
It must be free of perfume, body odor, deodorant or washing powder.
It must be free of makeup, tan marks, glitter and pet hair.
It must not be final sale (items with a 40% discount or more)
It must not include underwear, towels, socks or glasses.
Please note;
AZUL has the right to refuse returns that do not meet the above requirements. In this case, the items will be returned to you and fees will be recovered.
Store Credit
All orders* are eligible for store credit returns. Store credit is available for 1 month from the date of issue.
Store credits and gift cards are non-refundable and cannot be transferred for cash or refund. Discount codes and loyalty discount rewards are forfeited on store credit returns and cannot be reissued.
SIZE EXCHANGE
All orders* are eligible to be returned for exchange. We only offer one exchange per order, if you are returning an exchange this will only be eligible for store credit.
AZUL does not guarantee stock for your exchange order, it is subject to availability. Your exchange order will only be processed once your return is in transit to us.
Return Labels
We provide free return labels to select locations, for store credit and exchanges only.
Customer will be responsible for all return fees to our warehouse.
DEFECTIVE RETURNS
We pride ourselves on providing high quality and durable pieces for our customers, on the rare occasion that you receive an item that appears to have a defect, please email our customer service team immediately at azul.fitnnes@gmail.com. To assist with the returns process, you will be asked to send us photos of the fault for assessment by our product team. You may be asked to return the faulty item or provide further information to support your claim and assist us with our assessment of the goods. We ask that you do not wear, use or dispose of the item until the faulty claim has been finalised.
Once the assessment has confirmed a manufacturer fault, we will replace, credit or refund the item.
If, in our assessment, the team does not classify your item as defective, but rather it has become of unacceptable quality due to any of the reasons mentioned below, AZUL will not be responsible for providing a replacement or any type of compensation:

AZUL may cancel orders in case errors are detected in the system.
If the product is out of stock, your order will be cancelled and your money will be refunded to the same payment method.
SOCIAL MEDIA.
By tagging @a.zulfit on social media platforms, you acknowledge and agree that the content may be used on AZUL's social media, emails/SMS and in the as seen section of our site, and you grant us permission to use.
INDEMNIFICATION
The CLIENT agrees and undertakes to indemnify, defend and hold harmless AZUL and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms of Service or your violation of any law or the rights of a third party. AZUL has the full right to take control and manage any of the aforementioned contingencies.
SEVERABILITY
In the event that any provision of these Terms of Service is determined to be illegal, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.
TERMINATION
(a) The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
(b) These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by providing notice to us that you no longer wish to use our Services, or when you cease using our site.
(c) If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of Termination; and/or accordingly may deny you access to our Services (or any part thereof).
ENTIRE AGREEMENT
(a) Our failure to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
(b) These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitute the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

Complaints and clarifications
In the event that THE CUSTOMER makes a complaint or clarification, they may do so by sending us an email to azul.fitnnes@gmail.com, which may be received from Monday to Friday, from 9:00 a.m. to 8:00 p.m.
WARRANTIES:
90 (ninety) day warranty in accordance with the law for defects and/or factory defects. Given the COVID-19 contingency situation, returns are available within 30 (thirty) days from the date of purchase. It does not apply to underwear, bodysuits, face masks, swimsuits, or fashion gifts, or any other items indicated in these Terms and Conditions.
The warranty may be enforceable for defects or flaws in the products provided that they have not been used or washed or that the defects are not attributable to the consumer. Factory defects and/or flaws shall be understood as:
- Detachment of any of the components of the product.
∙ Unstitching of any of its components.
- Defect in the material or any element of the product.
- Any of its elements does not work.
PROFECO
AZUL states that the Federal Consumer Protection Agency is competent in the administrative process to resolve any controversy that may arise regarding the interpretation or compliance with these terms and conditions.
By accepting these terms and conditions, the consumer accepts YES or NO that AZUL transmits to third parties for marketing or advertising purposes, the information provided by him/her in connection with this Contract and accepts that he/she may be sent advertising about goods, products or services.
In the event that the consumer does not accept that his/her information be transferred or transmitted to third parties for marketing or advertising purposes and/or does not accept that the provider sends him/her advertising about goods and services, the provider declares that in the provision of the contracted services there will be no discrimination against the consumer for this fact, and is obliged to comply with the terms and conditions of the contract without any different treatment with respect to consumers who have expressed their consent to accept that their information be used for such purposes and/or to receive the relevant information.
